Terms that govern access to and use of Axon

Acceptance of Terms

Axon is operated by HERSTELLUNG SRL, a company registered in Romania, trading as XDBX Europe ('Axon', 'we', 'us').

By accessing or using Axon, you agree to these Terms of Service. If you use Axon on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree with these terms, do not use the service.

Eligibility and Accounts

You must provide accurate account information and keep your credentials confidential. You are responsible for activity under your account.

You must promptly notify us of suspected unauthorized use.

Service Scope and Changes

Axon provides modular tools for scheduling, bookings, mapping, and workforce workflows, delivered through the web app and the Axon mobile apps for iOS and Android.

We may modify, improve, or discontinue features to maintain security, reliability, and product quality.

Acceptable Use

You may not use Axon to violate laws, interfere with service operations, circumvent security controls, or access tenant data without authorization.

You may not reverse engineer, exploit, or abuse the platform, including excessive automated requests or attempts to disrupt availability.

Fees, Subscriptions, and Billing

Paid features are governed by the subscription plan selected by your organization. Billing is processed through Stripe or other designated payment providers.

Your organization is responsible for payment of applicable fees, taxes, and renewals unless canceled according to the plan terms.

Customer Data and Responsibilities

You retain responsibility for the data submitted to Axon by your organization and users, including lawful collection and sharing of that data.

You are responsible for configuring permissions and access controls to protect your tenant data.

Where we process personal data on your organization's behalf, our Data Processing Addendum is incorporated into these terms by reference and takes effect when you accept them.

Intellectual Property

Axon and related software, branding, and documentation are protected by intellectual property rights. Except for limited rights to use the service, no rights are transferred to you.

You grant us limited rights to process your data solely to provide and support the service.

Disclaimers

The service is provided on an as-is and as-available basis to the extent permitted by law.

We do not warrant uninterrupted or error-free operation, though we work to maintain service reliability and security.

Limitation of Liability

To the extent permitted by law, Axon and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from service use.

Any direct liability is limited to amounts paid for the service in the period required by applicable law.

Suspension and Termination

We may suspend or terminate access for violations of these terms, security risks, legal requirements, or non-payment.

You may stop using the service at any time; subscription obligations may continue until the end of the applicable billing period.

Changes, Governing Law, and Contact

We may update these terms. Continued use after updates means acceptance of the revised terms.

These terms are governed by the laws of Romania, and the courts of Romania have jurisdiction over disputes arising from them, except where mandatory law in your country of residence gives you the right to bring proceedings elsewhere.
